TOWNSVILLE TOY LIBRARY RAFFLE GENERAL TERMS AND CONDITIONS
- General terms and conditions
1.1 Townsville Toy Library raffle is conducted by the Townsville Toy Library ABN 84300577626
(‘TTL’ ‘we’, ‘us’ and ‘our’). The TTL raffle is conducted for the purposes of funding a new home and future co-op opportunities in Townsville pursuant to Queensland lottery licencing approvals as identified in the raffle-specific terms and conditions
1.2 For the purposes of these terms and conditions, ‘TTL’ means the Townsville Toy Library and Raffle, ‘Raffle’ means each individual raffle conducted by us, ‘General Terms and Conditions’ means this document and ‘Terms and Conditions’ means the General Terms and Conditions and any other document incorporated by reference in these terms and conditions. A reference in the Terms and Conditions to the singular includes the plural and vice versa.
1.3 The Raffle Terms and Conditions as well as any information on how to enter a Raffle and purchase tickets form part of the Terms and Conditions.
1.4 The Terms and Conditions apply to all entries into and/or prizes awarded in the Townsville Toy Library. We reserve the right to change the Terms and Conditions at any time without notice by posting such changes on our website https://townsvilletoylibrary.org.au/.
1.5 The laws of Queensland apply to the conduct of the Raffle and the construction of the Terms and Conditions
- Conditions of entry
2.1 To enter the Townsville Toy Library Raffle, a person must either purchase one or more tickets in the raffle via the below options
(a) cash or credit card payment accepted on our open sessions being every Tuesday & Saturday from 930am to 11am unless otherwise stated.
(b) messaging our facebook page with proof of direct deposit
(c) emailing hello@townsvilletoylibrary.org.au with proof of direct deposit
2.2 A person who enters a raffle (‘you, your’) is deemed to have accepted and agreed to the Terms and Conditions.
2.3 Entry in the Townsville Toy Library is open to Townsville & surrounding residents who are at least 18 years old who are not ineligible for entry (‘eligible person’). The following persons are ineligible for entry in the Raffle:
(a) a member of our management committee, including our board of directors and executive management.
(b) all other parties (and their employees and agents) directly engaged in conducting the Raffle;
(c) a family member of a person caught by paragraph (a), including spouses, de facto spouses, parents, step-parents, siblings, step-siblings, children and adopted children
2.4 It is your responsibility as an entrant in the Raffle to ensure that you are eligible under all applicable laws to accept the prize should you win the Raffle.
2.5 We reserve the right to disqualify entries in the event of non-compliance with the Terms and Conditions.
- Tickets
3.1 We will issue a ticket to you after we receive:
(a) payment in full for the ticket
regardless of whether received from you or another person.
3.2 Once a ticket has been issued, the details associated with that ticket (including your name and address) cannot be amended or updated.
3.3 Tickets are numbered, coloured and alphabetised
3.4 The following pricing applies to tickets in the Townsville Toy Library Raffle:
$2.00 – 1 ticket
$5.00 – 3 tickets
$10.00 – 10 tickets
There is no maximum for ticket purchases.
- Payments
4.1 Tickets in the Raffle must be purchased in Australian dollars via the following payment methods:
(a) cash or credit card payment accepted on our open sessions being every Tuesday & Saturday from 930am to 11am unless otherwise stated.
(b) messaging our facebook page with proof of direct deposit
(c) emailing hello@townsvilletoylibrary.org.au with proof of direct deposit
4.2 Only entries that have been paid for in full will be included in the Raffle.
4.3 Where you wish to purchase tickets by direct debit, you must make sure that payment is received by us no less than four (4) business days before the closing date of the Raffle. The funds must clear before we will issue any tickets to you. If:
(a) the funds are not received less than 4 Queensland business days before the closing date of the Raffle.
(b) the funds do not clear before the closing date of the Raffle; or
(c) the Raffle has sold out prior to the funds being received or clearing;
we will issue you tickets in the next Raffle, unless you request a refund.
4.4 Payments for the purchase of Townsville Toy Library Raffle tickets are not tax deductible.
- Banking
5.1 When you (or a purchaser) requests to purchase tickets using cash, this will be kept in the till to be banked the same day or next business day
- Privacy and Communications
6.1 Your participation in the Raffle constitutes an invitation for us to contact you in relation to, among other things, offering you tickets in future raffles, matters relating to your ticket purchase and to notify you of the outcome of the Raffle.
6.2 To purchase tickets in the Raffle, you must supply at least one method of contact for ticket issuance. We reserve the right to send service-related communications to you subject. These service-related communications may include, by way of example only, updates to the Terms and Conditions, to deliver tickets purchased and anything else required to fulfil your purchase from us.
- Disclaimer
7.1 Any and all products, brand names, logos, images and/or trademarks as displayed or referred to on the Townsville Toy Library website or Facebook page are owned by the respective trademark owners.
7.2 We use all reasonable endeavours to ensure that information on this website is correct, but we do not warrant the accuracy or completeness of the information provided and will not be held liable for any inaccuracy, omission, variation or error. Photographs are for illustrative purposes only and may not be to scale or depict exact prize detail or size. Raffle themes and prizes do not necessarily reflect our views or the views of our staff.
7.3 By entering the Raffle, you acknowledge that these terms and conditions provide adequate warning of eligibility requirements and alternative prize arrangements.
7.4 To the extent permitted by law, including pursuant to schedule 2 of the Competition and Consumer Act 2010 (Cth), (‘Australian Consumer Law’), we shall not be liable for any loss or damage of whatsoever nature however occasioned to any person by, through or in connection with the Raffle (including but not limited to direct, indirect, or consequential loss or damage or personal injury). We will not be liable to you or any winner for any financial consequences (including but not limited to any taxation liability.
7.5 All prize values are listed in Australian currency.
7.6 Prizes cannot be transferred or exchanged, and non-cash prizes are not redeemable for cash.
